How to Report Content
Overtone Art LLC operates overtone.art and mood.overtone.art. If something on either site infringes your copyright, uses your likeness without your permission, or shows you in intimate imagery you never agreed to share, tell us and we will act on it.
Send every request by email to hello@overtone.art. Email is the only channel we accept notices on — there is no form, portal, or phone line. Put the type of request in the subject line so it reaches the right person quickly:
- DMCA Notice — copyright infringement
- Counter-Notice — you believe your material was removed by mistake
- NCII Removal — non-consensual intimate imagery (handled first, within 48 hours)
- Likeness — a work or design uses your face or likeness without your consent
What Every Request Needs
Whatever the type, we need enough information to find the content and to write back to you:
- A direct link (URL) to each item, or the order or design reference if you have one
- Your name and an email address we can reply to
- A short description of the problem and what you are asking us to do
We acknowledge every report by email. If something required is missing we will tell you what it is — an incomplete notice does not start the clock. Please do not attach the material you are reporting; a link is enough.
Copyright Infringement (DMCA)
If you own a copyright, or are authorized to act for the owner, and you believe material on our sites infringes it, send a written notice to hello@overtone.art. Under 17 U.S.C. § 512(c)(3), a valid notice must contain all six of the following:
- A physical or electronic signature of the copyright owner, or of a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work you claim has been infringed — or, if one notice covers several works, a representative list of them.
- Identification of the material you claim is infringing, with enough detail for us to locate it. A direct URL to each item is best.
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
On receiving a valid notice we remove or disable access to the material identified, and we notify whoever uploaded or listed it. If an order containing that material has not yet gone into production, we cancel it. Knowingly misrepresenting that material is infringing can make you liable for damages, including costs and legal fees, under 17 U.S.C. § 512(f).
Counter-Notice
If your material was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to hello@overtone.art. It must contain:
- Your physical or electronic signature.
- Identification of the material that was removed, and the location where it appeared before it was removed.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number; a statement that you consent to the jurisdiction of the federal district court for the district where you live, or — if your address is outside the United States — for any district in which we may be found; and a statement that you will accept service of process from the person who filed the original notice.
We forward valid counter-notices to the person who sent the original notice. Unless they tell us they have filed a court action seeking to stop the activity, we may restore the material 10 to 14 business days after we receive your counter-notice. Knowingly misrepresenting that material was removed by mistake carries the same liability under 17 U.S.C. § 512(f) as a false infringement notice.
Repeat Infringers
We terminate the accounts of repeat infringers. Repeated valid notices against the same account end in permanent loss of access to overtone.art, mood.overtone.art, and the shared account behind them — including saved designs and any remaining credits. A single severe violation, such as non-consensual intimate imagery or content involving a minor, can end an account immediately without a prior warning.
Non-Consensual Intimate Imagery (TAKE IT DOWN Act)
If content on our sites shows you — or someone you are authorized to act for — in intimate imagery published without consent, including imagery that was synthesized or AI-generated, email hello@overtone.art with NCII Removal in the subject line and tell us:
- Where the content is — a URL, or the order or design reference
- That you are the person depicted, or that you are authorized to act for them
- How we can reach you
Do not attach the imagery itself. We will never ask you to send it to us to prove your claim.
We remove the reported content, and any copies of it we know about, within 48 hours of receiving a valid request. That covers gallery and storefront listings, previews, saved designs, and the generated files held in our systems. If the item had already been sent to a print partner, we ask them to stop production and destroy the file. These requests are handled ahead of everything else in our queue. You do not need a lawyer, a court order, or a fee to make one, and we never charge for removal.
We share your report only with the people who need it in order to remove the content. Where the law requires us to preserve records or to report content to the authorities, we do.
Likeness & Right of Publicity
If a photograph, design, or product uses your name, face, voice, or likeness without your permission — including a design another customer created from a photo of you — email hello@overtone.art with Likeness in the subject line. Tell us where the content appears, confirm that you are the person depicted or are authorized to act for them, and give us a way to reach you.
We disable the reported content while we look into it. Our Terms & Conditions require every customer to confirm they hold the rights to each photo they upload, including permission from anyone shown in it. Where that turns out not to be true, we cancel the order, refund the affected item, and may terminate the account.
AI-Generated Designs
Make Me Art, on our merch store at mood.overtone.art, lets a customer upload a photo and generate a custom design to print on merchandise. Uploads and generated designs are screened automatically before anything is produced, but automated screening is not perfect and we would rather hear from you.
To report a generated design, email hello@overtone.art with a link to the design or product page, the order number if you have one, and what is wrong with it.
We can decline to generate a design, refuse to print one, or pull one afterwards — at any point, before or after an order is placed — if we believe it infringes someone’s rights, uses a person’s likeness without consent, or otherwise breaks our Terms. If we pull a design from an order you already paid for, we refund that item.
